<br />the water in. This type of stormwater pond does not provide a great deal of flood control; they <br />generally only improve the aesthetics for the property owners adjacent to the pond, and not for <br />the community as a whole. Mr. Olson advised lined ponds may lose the integrity of their liner <br />through improper installation or damage to the liner by activities from property owners or <br />builders. This can sometimes go on for five to seven years, depending on how quickly the <br />subdivision gets built out and building permits get issued. A significant problem associated with <br />the repair of breached liners is the identification of the defect location. In addition, the repairs to <br />the liner are usually costly. It is proposed that the City take an active role during the inspection <br />of the pond liners during their installation. It would also be reasonable to require a surety <br />sufficient to cover the repair of the liner during the period when most construction activity by <br />builders is occurring. It is recommended that staff be directed to prepare a policy relating to the <br />installation of lined ponds within the City. Direction was given by the Committee that following <br />this time period, that any repair be undertaken as a public improvement project and special <br />assessed to the benefiting property owners directly adjacent to the pond. Mr. Olson stated there <br />was significant discussion by the Committee about how pond liners are similar in nature to <br />entrance signs into subdivisions which do not necessarily benefit everyone in the community. <br />The consensus of the Committee was to direct staff to develop a policy relating to the installation <br />of lined ponds within the City based on the above discussion. <br /> <br />Councilmember Elvig stated there was an in-depth discussion regarding this issue and that these <br />ponds are similar to private road issues. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Olson, to ratify the <br />recommendation of the Public Works Committee in Case No.1 and to direct staff to develop a <br />policy relating to the installation of lined ponds within the City based upon the discussion of the <br />Public Works Committee. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Olson, Dehen, Jeffrey, <br />Look, and Strommen. Voting No: None. <br /> <br />Further discussion: Councilmember Dehen stated his concern is that they have pond liners in the <br />City and will have maintenance issues down the road, and there are people moving in and out of <br />these subdivisions. He asked how the City is best protected from complaints that residents did <br />not know there would be this huge assessment in 20 years when these pond liners have to be <br />replaced. He questioned what the City can do to be proactive as far as making sure these are <br />recorded. City Attorney Goodrich advised there could be a recording on the property of the <br />potential assessment in the future with a reference to the policy of how it is to be paid. This <br />recording could be put in the public records of each property so it would be seen by future <br />owners when a title search is done. <br /> <br />Consensus of the Council was to direct staff to include the above provision referred to by the <br />City Attorney in the policy relating to the installation of lined ponds. <br /> <br />2) Consider Shouldering Material to be used in 2007 Street Maintenance Program <br /> <br />City Council / June 12,2007 <br />Page 23 of 29 <br />
