Councilmember Elvig indicated this case was discussed with the award of bids for the 2007
Pavement Maintenance Program.

3) Now and Then Street Improvements

Public Works Director Olson stated at the April 18, 2006 Public Works Committee meeting the
subject of the reconstruction of Garnet Street and 168th Avenue located in the Now and Then
Estates subdivision was discussed with the Committee. This subdivision is adjacent to the
Brookfield Addition which is served with municipal sanitary services. At that time Mr. John
Peterson of Oakwood Land Development indicated that he had spoken with the property owners
within Now and Then Estates and had reached a verbal understanding with approximately 80%
of them favorable to redevelopment. Ten of the 12 had indicated a desire to wait for some of the
construction activity to settle down before they move forward with reconstruction activity.
There could be redevelopment potential and there were those that were interested in selling.
Staff has contacted Mr. Peterson since the Public Works Committee meeting regarding the future
development. There are no firm commitments at this time from Mr. Peterson due to the slow
down in the residential market. It is not known how long that slow down will last. At some
point it would be in the City's best interest to at least do some repairs on this street, but at this
point he would like to try not to go forward with the repairs this year, and to possibly meet with
the neighborhood in the next few months.

Councilmember Elvig inquired about contacting the neighbors in this area.

Public Works Director Olson stated at this time staff would like to have one more discussion
with Mr. Peterson as the direction from the Committee requires. If that discussion is not fruitful
he would like to discuss with the neighborhood what their intentions are. If the residents do not
want to move forward with the installation of sewer and water, and would rather have the street
installed without that it could be done as a 2008 project. Mr. Olson indicated these two
roadways are probably the worst in the City. To the credit of the property owners there, there
have not been any complaints from the neighborhood. Staff has not directly contacted any of
these property owners to this point because they have not been directed to do that.

Committee Input

Update on Feasibility Study and Citizen Input for Pondvale Sewer and Water Extension

Councilmember Elvig stated there was a question regarding the ponding on the Asmussen
property in relation to this feaSibility study.

Public Works Director Olson indicated staff has not received an answer regarding this yet. They
are continuing to research this and expect to include it on the agenda of the Public Works
Committee meeting next week.

Renaming of 167th Avenue
Councilmember Elvig indicated one more issue that was raised was the potential of renaming
167th A venue and to include the topic on a future Public Works Committee meeting agenda.

City Council / June 12, 2007
