Case #3 <br />Case #4 <br /> <br />Proposed Adoption of a Moratorium Ordinance <br />Request for Preliminary Plat Approval of Alpine Estates; Case of K.C. Land <br />Company <br /> <br />In regard to the proposed moratorium ordinance, Mayor Gamec explained the Council had requested <br />the City Attorney to research issues brought forward at the last meeting. He recommended the <br />Council not pass on the proposed moratorium ordinance or preliminary plat approval of Alpine <br />Estates, at this time, and that both items be tabled until the Council has received a report from the <br />City Attorney in regard to questions raised at the last meeting. <br /> <br />Mayor Gamec asked that the position statement submitted by Good Value Homes be forwarded to <br />the City Attorney and entered with the rest of the documents. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to table Case #3, <br />Proposed Adoption of Moratorium Ordinance and Case #4, Request for Preliminary Plat Approval <br />of Alpine Estates; Case of K.C. Land Company until the April 8, 1997 meeting, to allow adequate <br />time for review by the City Attorney of questions raised. <br /> <br />Further Discussion: Councilmember Haas Steffen asked if tabling these actions will allow other <br />business to come before the Planning Commission. She noted that without a moratorium, more <br />developments will be added to the "pipeline." The City Attorney stated this is true but the Planning <br />Commission is advisory and the Council makes final decisions. Councilmember Haas Steffen asked <br />if discussion should be held with the Planning Commission about this issue so they understand the <br />difficulties and prevent other projects from entering the "pipeline." The City Attorney advised the <br />City must continue to receive applications but can table decisions as long as it abides by the 60-day <br />rule. Councilmember Haas Steffen suggested the Planning Commission be informed of these issues <br />so more projects are not entered into the "pipeline." She clarified she does not want to stop <br />applications from being made but to table them until a decision is reached on the proposed <br />moratorium ordinance. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer, Beahen, Haas Steffen and <br />Zimmerman. Voting No: None. <br /> <br />The Council dkected staffto relay these issues to the Planning Commission and ask them to take this <br />into consideration in their future recommendations to the Council. <br /> <br />Mr. Wissler asked for a clarification. <br /> <br />Mayor Gamec explained this issue is on "hold" pending advice from the City Attorney. <br /> <br />Case #5 <br /> <br />Request for Final Plat Approval of Regency Pond 2nd Addition; Case of Good <br />Value Homes <br /> <br />Zoning Administrator Frolik advised that John Peterson of Good Value Homes is requesting final plat <br />approval of the second phase of Regency Pond. The property is located in the northeast comer of the <br />intersection of Industry Avenue and Ramsey Boulevard.
