acres approved to be subdivided into approximately 135 single-family lots. Good Value Homes final <br />platted the first 46 lots in 1996, and is proposing to final plat another 38 lots at this time. Lots 1, 2 <br />and 3 of Block 4 are considered riparian to the wetland and meet the 15,000 square foot minimum <br />area requirement. All other lots exceed the minimum lot requirement and all meet lot width <br />requirements. She noted the extra deep easements provided for drainage and wetland on Lots l, 2, <br />and 3 of Block 4 have been dedicated. Park dedication consists of a cash payment and City Staff <br />recommends final plat approval contingent upon compliance with the City StaffReview Letter with <br />the impact fee issue being delayed pending City Attorney recommendation. <br /> <br />Mayor Gamec explained to Mr. Peterson that the transportation impact fee will be reviewed for <br />legality. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to adopt Resolution <br />#97-03-057 granting final plat approval to Regency Pond 2nd Addition contingent upon compliance <br />with City Staff review letter dated March 18, 1997, and the developer entering into a development <br />agreement with the City. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Beahen, Zimmerman, Beyer and Haas <br />Steffen. Voting No: None. <br /> <br />Case #6 <br /> <br />Request to Renew a Conditional Use Permit to Mine and Export Soils; Case of <br />Sidney Nyhusmoen <br /> <br />Zoning Administrator Sylvia Frolik explained that on April 26, 1994, the City Council granted a <br />conditional use permit to Sidney Nyhusmoen to mine and export soils from Lot 1, Block 1, HY-10 <br />Ramsey 4th Addition. That permit was issued with an expiration date of May 1, 1997. She explained <br />that on February 6, 1997, the City received a written request from Mr. Nyhusmoen for a renewal of <br />the permit because the project had not been initiated during the initial three-year permit. In <br />accordance with City Code, a public hearing was held by the Planning Commission. There were no <br />written or verbal comments submitted from neighboring property owners. Zoning Administrator <br />Frolik noted the subject property is approximately 4.4 acres in size, zoned Industrial, and surrounded <br />by industrially-zoned property. The grading plan proposes no importing of fill materials, no blasting, <br />and no impact to drainage. The applicant is proposing to strip the topsoil, export approximately <br />14,730 cubic yards of material, and replace the topsoil. The Planning Commission and City Staff <br />recommend approval of the permit as none of the circumstances have changed over the last three <br />years. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt Resolution <br />#97-03-058 adopting Findings of Fact #0418 relating to Sidney Nyhusmoen's request for a <br />conditional use permit to mine and export soils. <br /> <br />Motion carded.
