Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to approve Sidney <br />Nyhusmoen's request for a conditional use permit to mine and export soils from Lot 1, Block 1, HY- <br />10 Ramsey 4th Addition and adopt Resolution #97-03-059 declaring terms of same. <br /> <br />Motion carded. Voting No: None. <br /> <br />Case//7 <br /> <br />Request for a Conditional Use Permit to Grade and Export Soils; Case of Eric <br />Thomsen <br /> <br />City Engineer Jankowski advised on January 14, 1997, the City received an application from Eric <br />Thomsen to grade and export soils from an area generally located west of T.H. #47 and south of <br />County Road #63, at about Vanadium Street NW. The subject property consists of nine acres.' He <br />advised the grading plan requests approval to remove 200,000 cubic yards of materials from an area <br />of approximately nine acres. The application requests the duration of the permit to be for a five-year <br />period and the operation will occur in two phases. He advised of a concern with regard to erosion <br />impact so the applicant submitted a plan to divide the grading in two phases. He explained how the <br />top soil will be stripped from Phase One and used to create a berm which will be seeded and silt fence <br />installed to address possible erosion and provide erosion control for the mining operation. The <br />Planning Commission and City Staffrecommend approval of the request and permit as reviewed and <br />amended by the Planning Commission. <br /> <br />Councilmember Haas Steffen asked ifDNR approval is required. <br /> <br />City Engineer Jankowski explained a DNR permit is not required but an MPDES permit is required. <br /> <br />Councilmember Haas Steffen asked if the City is responsible for policing the work and conditions. <br /> <br />City Engineer Jankowski answered affirmatively and noted the need for an Anoka County permit to <br />transport the soil. <br /> <br />Mayor Gamec asked if this activity is reviewed. <br /> <br />City Engineer Jankowski noted the request is for five years but the permit is only for three years. In <br />this case, the Planning Commission also added a provision indicating the mining activity should be <br />completed within two years of commencement of operations. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt Resolution <br />#97-03-060 adopting Findings of Fact #0419 relating to Eric Thomsen's request for a conditional use <br />permit to grade and export soils. <br /> <br />Motion carried.
