City Attorney Goodrich stated that under definitions of non-functional private water system, he <br />changed the wording to reflect Minnesota rules and added a reference to the Minnesota Plumbing <br />Code. <br /> <br />Councilmember Zimmerman inquired as to who determines a non-functional system. <br /> <br />City Engineer Jankowski stated there is criteria established and if the property does not meet <br />these requirements, they are considered not functional. <br /> <br />Wayne Olson, 5830 - 151 st Lane NW, Ramsey, inquired what would constitute a non-functional <br />system. <br /> <br />Mayor Gamec explained that if you live on your lot forever, and you can repair your system, it is <br />still considered functional. <br /> <br />Attorney Goodrich added that any repair that's legally possible to do is okay. If it requires <br />additional land, and you run out of land, you will have a failed system. <br /> <br />Mr. Olson stated he would like the option of choosing whether to repair his system or not and he <br />would also like the new owner to have that option. <br /> <br />Councilmember Haas Steffen felt that the ordinance with the "due on sale" clause is the better <br />one where the City can recoup some of its expenses. <br /> <br />Mr. Olson stated that, as a matter of concession, he feels that's fair. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen to introduce <br />the ordinance implementing Chapter 8 of the City Charter. <br /> <br />Motion carried. Voting Yes: Mayor Garnet, Councilmembers Haas Steffen, Beahen, Beyer and <br />Zimmerman. Voting No: None. <br /> <br />Case #5: Request to Rezone Certain Property from B-3 Highway Business to R-1 <br /> Urban Residential; Case of Williams Investments, Inc. <br /> <br />Zoning Administrator Frolik stated that Mr. Williams has asked that this case be tabled until after <br />July 15, 1997. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Beyer to table this case <br />until after July 15, 1997, as per the request of the applicant. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beahen, Beyer, Haas Steffen and <br />Zimmerman. Voting No: None. <br /> <br />City Council/April 22, 1997 <br /> Page 9 of 18 <br /> <br /> <br />
