The issue to be addressed is how these properties should be <br />treated relative to assessments for the 2007 program. <br />The Committee directed that Potassium Street from 172" lane to Potassium street and Potassium <br />Court be eliminated from Project 07 -03 but be placed on the 2008 program following the storm <br />sewer work. <br />Motion to recommend to City Council that 15 properties along the area of 172 Lane and <br />Potassium Street would not be assessed for sealcoating in 2007 due to a delay in the storm water <br />improvement project, and that the properties would be included in the sealcoat assessments for <br />the 2008 Street Maintenance Program following the completion of the storm sewer installation. <br />Action: <br />Ratify the recommendation of the Public Works Committee and notify the affected residents of <br />this action. <br />Case #4 Consider Policy Regarding Lined Pond Maintenance <br />Background: <br />This topic was discussed by the Public Works Committee on May 15, 2007 and it was <br />recommended by the City Council that a policy be prepared and adopted. The purpose of this <br />• case is to translate the direction offered by City Council on this issue into the proposed policy. <br />The Committee and staff reviewed the proposed policy regarding lined pond maintenance. The <br />following was discussed in relation to the policy: <br />■ Requirement for a surety in the amount of 125% of the estimated cost to be held until the <br />last riparian property is constructed; any problem following this would be considered as a <br />public improvement project following the procedure outlined in City Code which <br />requires a feasibility study <br />Possibility of property owner concern that the City's method for fixing the problem is too <br />expensive. <br />o It was noted that the policy informs the residents that the City will offer the <br />service of correcting the problem but it will be billed to the adjacent property <br />owners; the repair would be done to the adjacent property owners' satisfaction <br />■ The policy should include a resolution that would be attached to the property deeds to <br />Rag the potential cost at the time of sale <br />o There was discussion of whether the resolution should be retroactive to include <br />properties that currently exist adjacent to lined ponds. It was determined that the <br />resolution should not be retroactive; it should include new properties moving <br />forward. Notification letters of the new policy should be sent to all affected <br />property owners.
