Motion to recommend to City Council that the Policy on the Construction and Maintenance of <br />Lined Ponds be adopted for all new ponds and that the City send a notification letter of the new <br />policy to the property owners adjacent to existing lined ponds. <br />Action: <br />Ratify the recommendation of the Public Works Committee. <br />Case #5 Consider Adopting Ordinance Requiring Dedication of the Vision Triangle <br />in City Right -of -Way <br />Background: <br />In 2004 Ordinance #04 -23 established a vision clearance triangle at each corner to provide <br />adequate sight distance for vehicles entering existing street intersections. In the process of <br />developing this ordinance it was anticipated that there would be conflicting interests between the <br />City's concern for public safety and the desires of property owners to' landscape their properties <br />and maintain privacy since it places restrictions on property owners for land uses that would <br />interfere with sight lines within this area. The Public Works Committee at their March 20, 2007 <br />meeting recommended eliminating this potential conflict on future streets by requiring that the <br />area of the vision triangle be dedicated as right -of -way. City Council ratified this <br />recommendation on April 10, 2007. Included in this report is an ordinance revising City Code <br />section 9.50.30 sub2 to effect this change. Staff recommends that the attached ordinance be <br />reviewed by the City Attorney and that. a public hearing on this ordinance be scheduled since <br />amendments to Chapter 9 of City Code require a public hearing. <br />The Committee questioned whether requiring additional right of way to be dedicated upon <br />subdivision was necessary in light of the 2004 Ordinance that created restrictions on private <br />property pursuant to sight distances at intersection. <br />Motion to recommend to City Council that the attached ordinance requiring dedication of the <br />vision triangle in City right -of -way be reviewed by the City Attorney and the full Council, and <br />that a public hearing on this ordinance be scheduled. <br />Action: <br />Ratify the recommendation of the Public Works Committee. <br />Case #6 Consider Renaming 167 Avenue to Here and There Avenue <br />Background: <br />According to the schedule in the current Capital Improvement Plan (C1P) 167 Avenue is <br />scheduled to become a collector street which will traverse nearly three miles across the City from <br />TH 47 to Armstrong Boulevard within the next couple of years. The final alignment of this <br />roadway will traverse segments of City streets which currently include portions of Jaspar Street, <br />—120— <br />
