Mayor Gamec pointed out that the problem with waiting for more input is that we keep delaying <br />this process. He suggested getting started and we could always add more services in. <br /> <br />Councilmember Zimmerman asked about CDBG money. <br /> <br />Mr. Schroeder responded that City staff will be submitting for grants to help defray costs. <br /> <br />Mayor Gamec stated he would rather see citizen involvement instead of a phone survey. <br /> <br />Mr. Schroeder suggested the phone survey could be added back in a few months into the <br />program. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to authorize <br />the Mayor and City Administrator to enter into a contract for Comprehensive Planning services, <br />with the inclusion of the phone survey, with the firm of Hoisington-Koegler Group Inc. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman and Beahen. Voting <br />No: None. Absent: Councilmembers Beyer and Haas Steffen. <br /> <br />Case #5: Introduce Right-of-Way Ordinance <br /> <br />Cable Commissioner Ken Peterson presented some information on the right-of-way ordinance <br />that was given to the Cable Commission as a result of the cable company using fights-of-way. <br />He noted that it is a very complex ordinance but the hope is to create an ordinance that would <br />standardize and make uniform right-of-way management provisions. This would set up a process <br />where the City can be compensated for fight-of-way damage. <br /> <br />Councilmember Zimmerman expressed concern for the small business who wants to use the <br />right-of-way. <br /> <br />Mr. Peterson stated that what's in the agenda is a model ordinance provided by the public <br />utilities for standardization. It's possible that for the smaller company, the City should look at a <br />modified form. He added that this would force the "small guys" to come into City Hall to make <br />staff aware that they are digging. He added that the City Engineer needs to review this also. Mr. <br />Peterson continued that the City has looked at franchise fees for a revenue source in the past. <br />This is more to ensure that the City gets the costs back that were incurred in managing the fight- <br />of-way. <br /> <br />Councilmember Zimmerman reiterated his concern that the small contractor would have to go <br />through a lot of paperwork. <br /> <br />Mr. Peterson responded that maybe a certain type of work could be excluded. <br /> <br />Consensus was that staff and the City Attorney will review this draft ordinance and bring back a <br />recommendation at a subsequent meeting. <br /> <br />City Council/July 8, 1997 <br /> Page 11 of 15 <br /> <br /> <br />
