Case #5: <br /> <br />Request for a Conditional Use Permit to Grade and Export Soils; Case of <br />Thomas Kurak <br /> <br />City Engineer Jankowski reported that the City received application from Thomas Kurak, who is <br />present, for a mining and grading permit. The request is to export approximately 800,000 yards <br />of soil from Mr. Kurak's property at 15001 Sunfish Lake Boulevard NW. The Planning <br />Commission held a public hearing and received a significant amount of public comment. They, <br />however, did pass the findings of fact and recommended approval of the conditional use permit. <br />Mr. Jankowski noted a letter received from Lori Schulz, 6090 - 151st Lane NW, that was <br />received after the Council packet went out. Ms. Schulz expressed concern about this major <br />excavating project and not having seen a development plan for the residential development <br />proposed. The City also received a letter addressed to Sylvia Frolik, dated July 22, 1997, from <br />the Department of Natural Resources. They listed the following concerns: (1) no written <br />application has been received to build duck ponds, (2) if de-watering for the operation is needed, <br />a water appropriation permit from the DNR may be required, (3) the sump pump to catch mn-off <br />is a good idea, however, a forester should have input of its location, (4) early phases of the <br />project should not involve removal of trees, (5) an erosion control and site rehabilitation plan <br />should be submitted. <br /> <br />Tom Kurak was present and was amiable to the suggestions/requirements of the DNR. He <br />suggested all this would be taken care of with staging/phasing the project. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to amend <br />Findings #24 to read: That the proposed use will be disturbing to existing c,r 5,:t'aro neighboring <br />uses during the term of the permit. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Beahen, Beyer, and <br />Haas Steffen. Voting No: None. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to add the <br />following Findings: #30) On July 22, 1997, the City of Ramsey received a letter from the <br />Minnesota Department of Natural Resources addressing the project and outlining certain <br />conditions they feel should be addressed in any permit to be issued and that the letter be made a <br />part of this record. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #97~07-178 adopting Findings of Fact #0433, as amended, relating to a request from <br />Thomas Kurak for a conditional use permit to grade and export soils. <br /> <br />Motion carried.
