Case #3: <br /> <br />Request for a Conditional use Permit to Grade and Export Soils; Case of <br />North Fork, Inc. <br /> <br />City Engineer Jankowski stated that, on July 21, 1997, the City received an application for North <br />Fork, Inc. to grade and export soils in various areas of the Northfork PUD. This project <br />encompasses four areas. The first project (Lots 1, 2 and 3 of Block 1, Northfork Highlands <br />Addition) consists of excavating approximately 2,000 yards of material within the subject area to <br />better define the "walk-out" building locations. The second project (Lots 3 and 4, Block 2, <br />Northfork Lake Addition) consists of exporting approximately 13,000 yards of material from the <br />involved lots so as to bring the building sites on the lots closer to the abutting streets. The third <br />project (Lot 1, Block 1, Northfork Links 3rd Addition) consists of exporting approximately 800 <br />yards of material from Block 2 of Itasca Shores to Lot 1, Block 1, Northfork Links 3rd Addition <br />to construct a seven-foot berm for a distance of 125 feet to act as a noise and sight barrier from <br />traffic on Highway #10. The fourth project area (Block 2, Northfork Itasca Shores Addition) <br />consists of exporting approximately 35,000 yards of material from Block 2 of Northfork Itasca <br />Shores in accordance with the approved grading plan for the plat. During the public hearing <br />conducted by the Planning Commission, there were no verbal or written comments received. <br /> <br />Mayor Gamec inquired how long the mining and grading would go on. <br /> <br />Dennis Peck, Director of Development for North Fork, stated that right now they have a grading <br />permit that is operational to 1999. That coupled with these, should be all there is. Much of it is <br />driven by the market and North Fork is just trying to get it out to facilitate development. He <br />added that they will try to do it in sympathy with the residents. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to adopt Resolution <br />#97-08-211 adopting Findings of Fact #0440 relating to a request from North Fork, Inc. for a <br />Conditional use Permit to grade and export soils. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beyer. Beahen and Zimmerman. <br />Voting No: None. Absent: CouncilmemberHaas Steffen. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Beyer to adopt Resolution <br />#97-08-212 approving the issuance of a conditional use permit based on Findings of Fact #0440 <br />and declaring terms of permit to grade and export soils. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beahen, Beyer and Zimmerman. <br />Voting No: None. Absent: CouncilmemberHaas Steffen. <br /> <br />Case #4: <br /> <br />Request for Approval of a Metes and Bounds Subdivision; Case of Jacob and <br />Peter Barthold and Good Value Homes <br /> <br />Zoning Administrator Frolik reported that Jacob Barthold had applied for a metes and bounds <br />subdivision to facilitate the development of the proposed plat of Apple Ridge.
