Good Value Homes may now begin site preparation and installation of improvements but their <br />policy is not to do so unless the land is held in fee title. Apple Ridge consists of one 40-acre <br />parcel and potions of other parcels owned by Jacob Barthold and his son Peter. Good Value <br />Homes desires to close on the land acquisition at this time and that doesn't present a problem <br />with the 40-acre parcel. However, to acquire the portions of Barthold parcels affected by the site <br />preparation prior to final plat requires an approved subdivision of those parcels. City Code <br />requires subdivision of land to be accomplished by platting unless there is a hardship. It is City <br />staff's opinion that requiring a minor subdivision for the acquisition of land currently being <br />platted in accordance with City Code is an unnecessary hardship. Council has, in the past, <br />approved similar requests. <br /> <br />Mayor Gamec stated he asked for information on when the Council has granted such a request in <br />the past since this has become somewhat a controversial development. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to adopt <br />Resolution #97-08-213 granting approval of a metes and bounds subdivision for Jacob and Peter <br />Barthold. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Beahen, Zimmerman, and Beyer. <br />Voting No: None. Absent: Councilmember Haas Steffen. <br /> <br />Case #5: <br /> <br />Adopt Ordinance Vacating Drainage and Utility Easements along the <br />Borders of Lot 1, Block 2, and Outlot C, of Rum River Hills Addition <br /> <br />City Administrator Schroeder explained that this ordinance had been introduced and a public <br />hearing had been held, however, the actual adoption was never done. To complete this vacation, <br />the ordinance has to be formally adopted by Council. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Ordinance #97-11 authorizing vacation of the drainage and utility easements dedicated along the <br />borders of Lot 1, Block 2, and Outlot C, of Rum River Hills Addition. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Beyer and Beahen. <br />Voting No: None. Absent: CouncilmemberHaas Steffen. <br /> <br />Case #6: <br /> <br />Adopt Ordinance Vacating the Section of Old Town Road (Sunfish Lake <br />Drive NW) East of County Road #57 (Sunfish Lake Boulevard NW) <br /> <br />City Administrator Schroeder noted that Council had conducted a public hearing on August 12, <br />1997, related to this vacation, and hearing no opposition, the ordinance was introduced. It is now <br />being presented to Council for formal adoption. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to adopt Ordinance <br />#97-12 authorizing vacation of street right-of-way of the Old Town Road, west of County Road <br />#57 (Sunfish Lake Boulevard NW). <br /> <br />City Council/August 26, 1997 <br /> Page 8 of 18 <br /> <br /> <br />
