(Construction of Alpine Park) contingent upon Minnesota Pollution Control Agency approval
and that the closing on the land for Alpine Addition occur as that is where the funding for the
park will come from.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and
Zimmerman. Voting No: None.

Case//4: Development Approvals

City Administrator Schroeder pointed out that, given staffing turnover, staff is trying to bring
some development projects to conclusion. About a year ago, City Council authorized eminent
domain at 14010 Sunfish Lake Boulevard in order to facilitate redevelopment activities. There
were concerns expressed that we should still work with the property owners and try to facilitate a
market sale. This purchase is intended to facilitate activities on the adjacent property and would
also involve some site improvements to some property on Highway #10. This evening, we have
a purchase agreement that has been "nodded off" on by the owners of the property and staff is
asking Council for ratification. He noted Catherine Dickenson in the audience.

Catherine Dickenson stated her family has been operating their business on Highway//10 for
about 30 years, however, they have gotten out of repair work and into manufacturing. She
disseminated a brochure showing their product.

City Attorney Goodrich noted that page 5, paragraph 17 of the purchase agreement shows the
seller is asking that we close on the property now, but that we do not take possession until May
15.

Ms. Dickenson stated that the reason for the May 15 date is to allow for smooth transition. She
added they will pay rent for the period between closing and transfer of possession.

Attorney Goodrich reported the rent would be $1,000, but that Mr. Dickenson wants a larger
down payment and that will be discussed. The purchase price is in the amount of $175,000.

Mayor Gamec stated he would not have a problem with this and felt that $1,000 per month rent is
in line.

Ms. Dickenson stated that she and her father are very willing to work with the City and that they
will make every effort to accommodate whatever the City needs.

Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to authorize the
Mayor and City Administrator to enter into a purchase agreement for the acquisition of the
property at 14010 Sunfish Lake Boulevard NW and that rent will be paid at a rate of $1,000 per
month and actual acquisition will happen on or before May 15.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and
Zimmerman. Voting No: None.

City Council/September 9, 1997
