Case #3: <br /> <br />Request for a Conditional Use Permit for a Metal Accessory Building on Less <br />than 2.5 Acres; Case of Scott and Lori Jones <br /> <br />Zoning Administrator Frolik stated that the City received an application from Scott and Lori <br />Jones for a conditional use permit to construct a metal accessory building on less than 2.5 acres <br />on their property at 16000 St. Francis Boulevard NW. City Code establishes a threshold of 2.5 <br />acres in order for residential property owners to have the metal pole barn type accessory <br />buildings. When Mr. and Mrs. Jones purchased their property, they were told that the property <br />was 2.5 acres in size and qualified for a pole barn. They were denied a building permit because <br />their property is actually 1.7 acres in size. The Jones' did sue the realty company and the courts <br />determined that they were wronged. In any event, they have applied for a conditional use permit <br />for a metal accessory building on less than 2.5 acres. The City has granted similar permits in the <br />past for the storage of personal equipment and vehicles when there is a sufficient amount of <br />natural screening existing on the property. The Planning Commission conducted a public <br />hearing and no neighbors were present to oppose the request, therefore, City staff and the <br />Planning Commission recommend approval of the request based on the natural screening in <br />place. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #97-10-308 adopting Findings of Fact #0445 relating to a request from Scott and Lori <br />Jones for a Conditional Use Permit to construct a metal accessory building on less than 2.5 acres. <br /> <br />Motion carried. Voting Yes: Councilmembers Haas Steffen, Beyer, Beahen and Zimmerman. <br />Voting No: None. Absent: Mayor Gamec (this is in the Mayor's neighborhood). <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt <br />Resolution #97-10-309 approving the issuance of a conditional use permit based on Findings of <br />Fact #0445 and declaring terms of permit to have a metal accessory building. <br /> <br />Motion carried. Voting Yes: Councilmembers Haas Steffen, Beyer, Beahen and Zimmerman. <br />VotingNo: None. Absent: Mayor Gamec. <br /> <br />Mayor Gamec is back in the chambers to preside over the meeting. <br /> <br />Case #4: <br /> <br />Request for Site Plan Approval of Blatz/Mach 5 Accessory Building; Case of <br />Randy Barrows <br /> <br />Zoning Administrator Frolik reported that Randy Barrows is seeking site plan approval to <br />construct an 896 square foot accessory building at the Blatz/Mach 5 automotive repair facility at <br />7105 Highway #10 NW. The accessory building will provide two additional service bays for <br />automotive repairs. The building is proposed to be sided with vertical wood siding to be <br />compatible with the exterior finish on the principal building. This exterior finish choice deviates <br />from code requirements for natural or prefabricated stone, but Council has the option to approve <br />it. The size of the structure exceeds the code restriction for limits on accessory building sizes but <br />code also gives Council the option to approve those deviations.
