<br />Management Intern Gladhill advised this zoning amendment is being processed along with the <br />site plan and preliminary plat for CNP Storage. State Statute requires cities to rezone property <br />accordingly once a Comprehensive Plan Amendment has been approved. Staff would note that <br />only the 2 residential parcels on the comer are being rezoned at this time; for the commercial <br />portion of this project to move forward, an additional rezoning is needed for a portion of Outlot <br />A of Regency Pond. <br /> <br />Staff recommends approval of the zoning amendment. <br /> <br />Citizen Input <br /> <br />Mr. Steve Schmidt TSM Development, 222 Momoe Street, Anoka, MN, stated the front acre and <br />a half of this parcel was previously guided to be rezoned to B-1 and the back piece he owns is <br />not. He is submitting a plat for four lots and he is requesting lots 2-4 be zoned B-1 and lot 1 stay <br />E 1. In the write up it appeared they are just doing the front half of lots 2-4. <br /> <br />Assistant Community Development Director Frolik indicated that is all they can do right now <br />because the previous Comprehensive Plan amendment only included Mr. Smith's property, Mr. <br />Smith's property, and Mr. Schmidt's property was not part ofthe land use change so they have to <br />go back and pick up the rest of that property with a Comprehensive Plan amendment and <br />rezomng. <br /> <br />Mr. Schmidt wondered where they would leave him because his lots will have dual zoning; E-1 <br />and B-l. <br /> <br />Assistant Community Development Director Frolik indicated Mr. Schmidt can file a <br />Comprehensive Plan Amendment to. change the remaining E-1 to B-1. Staff discussed the time <br />frame to file an amendment with the Met Council. <br /> <br />Motion by Commissioner Nixt, seconded by Commissioner Brauer, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Brauer, Cleveland, Hunt, Trites <br />Rolle, and Van Scoy. Voting No: None. Absent: Commissioner Levine. <br /> <br />The public hearing closed at 9:20 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 9:20 <br />p.m. <br /> <br />Commissioner Brauer wondered if they wanted to put into the findings the Met Council approval <br />of the amendment. He thought this was a significant finding that should go in there. <br /> <br />Motion by Commissioner Nixt, seconded by Commissioner Trites Rolle, to recommend the City <br />Council adopt Findings of Fact relating to a request from TSM Development to rezone the <br /> <br />Planning Commission/August 2, 2007 <br />Page 3 of 16 <br />
