<br />Motion by Commissioner Nixt, seconded by Commissioner Trites Rolle, to recommend that City <br />Council adopt Findings of Fact relating to Jeff Anderson's request for a home occupation permit <br />with a condition of hours of operation being limited to seven days a week from 9:00 a.m. to 9:00 <br />p.m. and limiting the business to one device. <br /> <br />Further discussion: Commissioner VanScoy indicated the number of customers will be limited <br />by the device so he thought by limiting it to one device with the hours of 9:00 a.m. and 9:00 p.m., <br />seven days a week would control the number of customers. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Trites Rolle, Brauer, Cleveland, <br />Hunt, and Van Scoy. Voting No: None. Absent: Commissioner Levine. <br /> <br />Motion by Commissioner Nixt, seconded by Commissioner Trite Rolle, to recommend that City <br />Council approve Jeff Anderson's request for a home occupation permit based on the Findings of <br />Fact. <br /> <br />Motion Carried. Absent: Commissioner Levine. <br /> <br />Case #6: <br /> <br />Public Hearing - Request for Comprehensive Plan Amendment; Case of <br />Sunfish Development, LLC <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 9:52 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearinf! <br /> <br />Chairperson Nixt called the public hearing to order at 9:52 p.m. <br /> <br />Presentation <br /> <br />Associate Planner DaInes stated Mike Wayman of Sunfish Development, LLC has applied for a <br />comprehensive plan amendment to re-guide the Healthquest property (14100 Sunfish Lake <br />Boulevard) from Places to Work to Places to Shop. The Planning Commission and City Council <br />have discussed this item previously. <br /> <br />Associate Planner DaInes stated this IS a lot split and a site plan for a multi-tenant retail <br />associated with one of two lots. <br /> <br />Chairperson Nixt stated once they rezone they lose the flexibility to guide what may be the use <br />on the portion that is not being developed at this time. <br /> <br />Mr. Mike Wayman stated they do not have any inclination to put a gas station on this site. <br /> <br />Commissioner Brauer asked if multi-tenant retail was the same thing as a strip mall. <br /> <br />Planning Commission/August 2, 2007 <br />Page 7 of 16 <br />
