<br />Chairperson Nixt stated the Planning Commission is fully aware of the zoning laws, and that is <br />exactly what this process deals with. There is a procedure by which the applicant can request a <br />use that is not deemed to be completely inconsistent with the residential character. <br /> <br />Ms. Vicki Atkinson stated she lives across the road from the Abendroths. She understands this is <br />zoned for a daycare, and that is a done deal, but she does not know that there has to be a deli. <br />Schools are very capable of not having full kitchens any more, and very few do. There are a lot <br />of companies that provide catering on a per student basis, and a lot of students choose to bring <br />their lunches. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Van Scoy, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners VanScoy, Brauer, Hunt, <br />Levine, and Trites Rolle. Voting No: None. Absent: Commissioner Cleveland. <br /> <br />The public hearing was closed at 7:42 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:42 <br />p.m. <br /> <br />Chairperson Nixt requested that the commissioners that do not live in this neighborhood lead the <br />discussion. <br /> <br />Commissioner VanScoy stated he has concerns about the traffic. He requested clarification that <br />it is reasonable to request a traffic analysis. <br /> <br />City Engineer Jankowski replied a traffic analysis is usually done with plat subdivisions; this is . <br />not a subdivision. <br />Commissioner VanScoy asked if traffic studies were previously completed with the subdivisions <br />that were done in this area. <br /> <br />City Engineer Jankowski replied there have been traffic studies for The Meadows and Shade <br />Tree Cottages. He does not have that information with him tonight. He does not recall any <br />limiting conditions on 157th Lane associated with the studies; they could be reviewed. <br /> <br />Commissioner Brauer commented on the traffic on Highway 5 in general, and. the increase in <br />traffic on that highway. He questioned at what point they reach the tipping point on Highway 5 <br />where there is so much traffic being generated that in effect it is creating an unsafe situation. <br /> <br />City Engineer Jankowski replied that is a good question that is raised with almost every <br />subdivision they have. The City's position has been that they need to continue working with the <br />other regional agencies, including the County and MnDOT, to increase capacity on those <br />roadways. Also, they are meeting with the County as part of the process with the City's <br /> <br />Planning Commission/ July 11, 2007 <br />Page 8 of21 <br />
