<br />Comprehensive Plan and the County's transportation planning process. He thinks it is too <br />simplistic to say that when there is a certain amount of traffic they will not allow any more <br />development. They cannot do that, but they need to keep looking and planning ahead, which is <br />what staff is trying to do. <br /> <br />Commissioner Brauer stated he would encourage staff as they work through the comprehensive <br />planning process to look at that tipping point issue, and plan down the road for the potential of <br />that happening. They all know that Highways 5 and 47 are huge problems, and they know they <br />are not only Ramsey's problem. They are as much of a County or State issue as the City's, but <br />the City seems to have the burden of the improvements. <br /> <br />Commissioner VanScoy requested information regarding the septic system, which is a question <br />that was raised. <br /> <br />City Engineer Jankowski replied this is addressed more in the next case, but if the applicant is to <br />go with a daycare and the food preparation facility they will need to bring the existing septic <br />system up to current standards, which likely will mean replacing the entire septic system, or the <br />will need an extension connecting to city sewer and water, which is nearby but not immediately <br />adjacent. If it turns out that they would be taking an extension there would be a significant cost <br />associated with that, and the City has a charter which states that existing homes cannot be <br />assessed unless they choose to hook up. It would be the applicant's choice on whether they <br />invest the money to upgrade the septic system. Mr. Jankowski advised he also believes the <br />whole building would need to be sprinkled. There would either need to be significant expense <br />associated with a fire protection system or the extension of sewer and water. <br /> <br />Commissioner VanScoy verified with Associate Planner Geisler that although this is a <br />residential area the owner has been granted a right through the conditional use permit to put a <br />daycare in at this facility. He asked if this is a use that is allowed in the R-l District. <br /> <br />Associate Planner Geisler replied yes, it is specifically called out in the existing conditional use <br />permit. <br /> <br />Commissioner Brauer questioned at what point, when they keep renewing the conditional use <br />permit over and over for what is essentially a business in a residential area, do they step over the <br />line. He indicated he would almost be more comfortable doing this as a zoning change than as a <br />conditional use permit that sets all kinds of precedence. <br /> <br />Associate Planner Geisler advised if the property was to be rezoned it would be open to the full <br />range of permitted uses. With the conditional use permit there can be conditions attached, such <br />as limiting the number of seats in the deli or hours of operation. <br /> <br />Chairperson Nixt stated he would not support a rezoning of the property. <br /> <br />Commissioner Hunt noted that under the circumstances the daycare center has been <br />grandfathered in, and that part of the traffic does not come into the decision tonight.
