Councilmember introduced the following resolution and moved for its <br />adoption: <br />RESOLUTION #07 -08- <br />RESOLUTION ADOPTING FINDINGS OF FACT .# RELATING TO A REQUEST FOR <br />FINAL PLAT APPROVAL OF A SUBDIVISION PROPOSED TO BE NAMED GAR'S PRAIRIE <br />WHEREAS, TRI -COR DEVELOPMENT, LLC, hereinafter referred to as "Applicant," has properly <br />applied for final plat approval of the GAR'S Prairie addition on the following legally described property <br />located in the City of Ramsey: <br />That part of the southwest quarter of the Northwest Quarter of Section 25, Township 32, Range 25, Anoka <br />County, Minnesota described as follows: <br />Commencing at the West Quarter Corner of said Section 25; thence on an assumed bearing of North <br />90 degrees 00 minutes 00 seconds East, along the south line of the Southwest Quarter of the Northwest of <br />said Section 25, a distance of 829.6 feet to the point of beginning: thence North 40 degrees 49 minutes 30 <br />seconds West a distance of 401.96 feet; thence North 87 degrees 34 minutes 50 seconds East a distance of <br />centerline, a distance of 430.2 feet more or less to said south line of the Southwest Quarter of the Northwest <br />Quarter. Thence westerly, along said south line, a distance of 310.0 feet more or less to the point of <br />beginning. <br />(the "Subject Property ") <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, <br />ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are <br />determined to be as follows: <br />1. That the applicant has properly applied for final plat for a major subdivision, in accordance with <br />9.50.02 of City Code. <br />2. That the Planning Commission considered the sketch plan for GAD's Prairie on March 2 n1 , 2006. <br />3. That the Planning Commission conducted a public hearing for the preliminary plat and rezoning <br />request to Planned Unit Development, pursuant to Section 9.03.03 of the City Code on June 1, 2006 <br />and said public hearing was properly advertised, and the minutes of said public hearing are hereby <br />incorporated by reference. <br />4. That the Planning Commission considered the preliminary plat and zoning amendment at the public <br />hearing and recommended denial of the preliminary plat and rezoning, based on the inappropriate use <br />of a PUD and concerns with the proposed access off CSAH 5. <br />5. That, on June 27, 2006 the City Council introduced an ordinance to rezone the Subject Property to <br />Planned -Unit- Development. <br />6. That the City Council approved the preliminary plat of GAD's Prairie, contingent upon: 1) receiving a <br />rezoning to Planned Unit Development (PUD); 2) installing of a temporary cul -de -sac and <br />conveyance of an access easement to the City across Lots 1 and 2; 3) Lots 1 and 2 being classified as <br />outlots; and 4) compliance with the City Staff Review Letter, dated May 24, 2006, revised June 23, <br />2006. <br />—187- <br />
