Dated August 9, 2007 <br />CITY OF RAMSEY <br />BURNS TOWNSHIP <br />JOINT POWERS FIRE PROTECTION AGREEMENT <br />WHEREAS, The City of Ramsey ( "Ramsey ") and Burns Township ( "Burns ") desire to <br />cooperate in the provision of fire and rescue services to portions of Ramsey and all of Burns for <br />the purposes of increasing service capacity and decreasing response time, and reducing the cost <br />of providing fire and rescue services to both communities; and <br />WHEREAS, Ramsey currently has an operating fire department consisting of two fire <br />stations, several fire and rescue apparatus, other fire and rescue equipment, and a complement of <br />paid on -call firefighters and some full time fire staff, including a full time fire chief (the "Fire <br />Chief') and fire marshal (collectively the "Fire Department"); and <br />WHEREAS, Burns Township is in the process of outfitting its former maintenance <br />building as a fire station and intends to purchase fire fighting and rescue equipment to outfit said <br />station; and <br />WHEREAS, Burns expects to have a fire truck operational from its fire station in the <br />second quarter of 2008; and <br />WHEREAS, Minnesota Statutes Section 471.59 authorizes two governmental units by <br />written agreement entered into through action of the governing bodies to jointly or cooperatively <br />exercise any power common to the contracting parties; and <br />WHEREAS, two or more governmental units through action of their governing bodies <br />by adoption of a joint powers agreement may establish a joint powers board composed solely of <br />members of the cooperating governing bodies; and <br />WHEREAS, the City is a charter city pursuant to Minnesota statutes 410 et seq and the <br />Township is an "urban township" pursuant to Minnesota Statutes 368 et seq; and <br />WHEREAS, Minn. Stat. Section 368.01, Subd. 9 authorizes the Township to establish a <br />fire department and Minn. Stat. Section 410.33 and the Ramsey City Charter, Section 12.7 <br />authorize Ramsey to enter into this Agreement; and <br />WHEREAS, after conference, study and deliberation, the respective City Council and <br />Township Board of Supervisors have found and hereby find it to be advisable to utilize selected <br />buildings and equipment jointly for use in preventing and extinguishing fires, and providing <br />rescue services within both jurisdictions and beyond; and <br />-224- <br />
