which appointed such member upon a majority vote of such appointing Town Board <br />or City Council. Initial appointments to the Board shall be made within 30 days of <br />the execution of this Agreement by Ramsey and Burns. <br />D. Two members of the fire department, one of which will be the Fire Chief or his <br />designee and the other who shall be appointed by the Board, shall provide advice to <br />the Board but will have no voting power. However, it is the intention of the parties <br />that the advice of the Fire Chief regarding equipment needs be given a high degree of <br />deference in that both communities will benefit financially from the coordination of <br />equipment purchases, while recognizing that the final decision to authorize the actual <br />purchase of such equipment rests with Burns and Ramsey, respectively. <br />E. In the event that the Board deadlocks on a decision which must be made in order for <br />adequate emergency fire and rescue services to be provided under this Agreement <br />(such as approving the rates to be charged Ramsey and Burns) the parties agree to <br />appoint one of the following people, in order of preference as listed below, as a <br />temporary fifth Board member for purposes of voting on the deadlocked issue, <br />provided that no such fifth member may be a resident of either Burns or Ramsey: <br />i. President of the Anoka County Fire Protection Council <br />ii. Anoka County Sheriff <br />iii. Chair of the Anoka County Board <br />iv. The fire chief from an area municipality, said fire chief to be chosen by the <br />Board from time to time as the Board sees fit, provided that the Board shall <br />initially chose this person at its first Board meeting. <br />F. The Board shall hold a minimum of four regular meetings in the first calendar year <br />and at least two regular meetings annually thereafter, one in January and one in July. <br />The Board may schedule regular or special meetings more frequently if desired by the <br />Board. Unless the Board fixes a different meeting place, the meetings shall be held <br />alternately at Burns' and Ramsey's public meeting place. Meetings of the .Board are <br />subject to the Open Meeting Law, Minn. Stat., Chapter 13D. <br />G. At least annually the Board shall meet to review the performance of the fire <br />department, costs of service, equipment needs, rates and charges, and other matters <br />governed by this Agreement. The Board shall make recommendations to Burns' <br />Town Board and Ramsey's City Council regarding fire and emergency response <br />services. <br />H. The Board may from time to time adopt and amend rules of procedure for the purpose <br />of carrying out its duties consistent with this Agreement. <br />I. The Board shall not own any equipment or buildings, nor shall it acquire any assets. <br />If any assets do come into its possession via grant or otherwise, the assets shall be <br />used as the Board deems best to carry out the objectives of this Agreement. <br />Vic? <br />-226- <br />
