the State from the property owners on the east and west sides of T.H. #47 as shown on the layout. <br />If the access, control is not granted, the City street will remain a cul~de-sac and the T.H. #47 and <br />C.S.A.H. #5 intersection will remain a T with improved channelization and a signal system. He <br />stated that he will ask the State to waive the access control for some of the properties which are <br />unlikely to request future access points, such as the six residential properties in the Flintwood 3rd <br />subdivision. Mr. Jankowski also indicated that access control is a compensable right, and if it is <br />not freely dedicated, it could be obtained by eminent domain, however, the property owner <br />would then need to be compensated fairly. <br /> <br />Councilmember Zimmerman expressed concern about the cost for the City and inquired if it <br />made sense to meet with MnDOT and get some of the costs grouped more. <br /> <br />Mr. Jankowski suggested the City could respond to MnDOT and give them a counter proposal. <br />If MnDOT proposed the project and we paid our fair share - a legitimate amount would be about <br />$220,000. The cost now is at about $1 million for the City, without any cost for the access <br />control, and the cost to the County is about $225,000. <br /> <br />Councilmember Haas Steffen felt that T.H. #47 was "on the way out". She suggested if the State <br />finds another north/south route, they would turn #47 back to the City and she felt there should be <br />another route. <br /> <br />Mr. Jankowski responded that regardless if #47 is a State highway or not, it will continue to be <br />an arterial roadway and there's a lot of people interested in seeing it improved. <br /> <br />Consensus was that a meeting should be set up with MnDOT, Anoka County, the City and <br />affected landowners. <br /> <br />Case #2: Septic Inspection and Maintenance Program <br /> <br />Due to time constraints, this case was tabled to a subsequent meeting. <br /> <br />Case #3: Water Utility Improvements <br /> <br />City Engineer Jankowski reported that Well #3 is complete and the test pumping shows that the <br />well will deliver 1,200 gallons per minute (gpm) of sand-free water, which exceeded the desired <br />target of 1,000 gpm. He also reported that BRA is putting together pay estimates covering the <br />actual quantities for the work associated with the construction of Well No. 3. We have also been <br />asked by the contractor for consideration on the liquidated damages which amounts to $7,400 (37 <br />days at $200 day). (He noted a letter from Steve Alberg which explained a delay due to their <br />equipment being detained on site in Elgin.) Mr. Jankowski recommended that the City collect <br />the liquidated damages as specified in the contract and advise Alberg that he should attempt to <br />reclaim them from the City of Elgin project since they caused his delay. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Haas Steffen that the <br />Committee agrees with staff recommendation. <br /> <br />Motion carried.
