<br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to table a request for <br />preliminary plat approval of Bridgewater; Case of CBR Development. <br /> <br />Motion carried. V oting Yes: Mayor Gamec, Councilmembers Elvig, Jeffrey, Dehen, Look, <br />Olson, and Strommen. Voting No: None. <br /> <br />Case #7: <br /> <br />Adopt an Ordinance Amending Chapter 5 (Municipal Regulations), Sections <br />5.08 (Public Nuisances), 5.11 (Weeds), and 5.12 (Condition of Premises) of <br />the City Code; Case of City of Ramsey <br /> <br />Mayor Gamec stated his understanding was that this ordinance was to be discussed further. at a <br />work session. <br /> <br />Interim City Administrator Nelson explained staff tried to capture all of the comments of Council <br />at the last meeting. They truly need to get something adopted with this ordinance, and <br />postponing it to a work session prior to including it on another City Council meeting will push <br />this back another month. The abatement ordinance is in place and there is pressure from the <br />community to deal with some of the issues. There has been an article about the abatement <br />ordinance in the City Newsletter, and the community is aware the City has put something in <br />place to deal with properties that are in violation. Staff thinks they have addressed the issues <br />identified at the last Council meeting. There are a couple of items to walk through and receive <br />direction on, but staff thinks the bulk of Council's concerns have been addressed. Staff is asking <br />for Council's consideration this evening to move this ordinance forward for adoption. <br /> <br />Community Development Director Trudgeon outlined the following amendments to the <br />ordinance to address the primary points of discussion that were raised at the August 28, 2007 <br />City Council meeting: <br /> <br />1. Clarified the definition of prairie restoration and plant materials; including an exemption <br />from the 12 inch height restriction. <br />2. Better defined abandoned and inoperable vehicles. <br />3. Added "stockpiles of rocks and dirt" to the public nuisance list. <br /> <br />Community Development Director Trudgeon requested further policy direction regarding the <br />following items: <br /> <br />1. Garbage can regulations. Staff feels any changes to the regulations regarding garbage <br />cans are most appropriately addressed through an amendment to Chapter 9 of the City <br />Code. <br />2. The definition of "nighttime". Staff recommends maintaining the "nighttime" definition <br />to begin at 10 p.m. This is a commonly accepted time among other cities' ordinances and <br />represents park hours and weekend curfew for children and the weekday curfew for <br />younger teenagers. <br />3. Varying yard maintenance standards for urban vs. rural parcels. Staff feels this subject <br />also is more appropriately addressed in Chapter 9 performance standards for residential <br />districts. <br /> <br />City Council / September 11,2007 <br />Page 10 of22 <br />
