City Engineer Jankowski responded that the drainage runs from west to east away from
neighboring properties.

Commissioner Holland stated that he would prefer a time limit of less than three years, which he
believes to be a long time for a truck hauling project.

Commissioner Deemer stated that the work from start to finish would take approximately 100
days or 20 weeks. He suggested issuing an interim use permit to give Mr. Thompson 60 weeks to
complete excavation.

Mr. Thompson stated that he would propose to limit the contractor to two years.

One resident suggested that the fill be required to be removed before the state starts repaving
T.H. 47.

Chairperson Bawden responded that there is no guarantee when the state will repave T.H. 47.

Commissioner Deemer added that the state has delayed the project twice.

City Engineer Jankowski stated that the state has funded the repaying of T.H. 47 for 1999. He
agreed that there is no guarantee, but he believes the work will be done at that time.

Motion by Commissioner Deemer, seconded by Commissioner Holland to accept Nos. 1 through
8 of the Findings of Fact, as presented.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Jensen,
LaDue, Terry, and Thorud. Voting no: None. Absent: None.

Motion by Commissioner Deemer, seconded by Commissioner Terry to accept Finding No. 9 with
the word change of"along" instead of the word "around."

Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Jensen,
Holland, LaDue, and Thorud. Voting no: None. Absent: None.

Motion by Commissioner Holland, seconded by Commissioner Jensen to amend Finding No. 10 as
follows:

"That the grading operation will increase the traffic to and from the subject
property for the period of time that the Conditional Use Permit is granted."

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Jensen, Deemer,
LaDue, Terry, and Thorud. Voting no: None.
