Mr. Goodrich replied that it would appear to be the resolution but that is being reviewed.

Mr. Hendriksen replied that at one meeting the citizens were told that it was Resolution #93-11-
263, then another time they were told that it was Resolution #95-01-118. The citizens want to
know if there is yet another resolution out there that is being discussed or reviewed.

Mr. Goodrich replied that the City is reviewing all of those resolutions.

Mr. Wissler reiterated that Mr. Goodrich said the land was sold legally and inquired if in fact it is
sold and has the purchase deal been closed.

Mr. Goodrich replied that the purchase has not closed but it is subject to a valid purchase
agreement.

Mr. Wissler stated that then if the purchase has not closed, the City can still null and void this
sale and project. He then inquired which Realtor is involved in this project.

Chairperson Bawden replied that the name of the Realtor is not an appropriate question at the
rezoning hearing.

Mr. Goodrich interjected that no Realtor was involved in the purchase agreement from the City
to the developer.

Mr. Wissler inquired as to what the process is for rezoning.

Mr. Goodrich replied that the City believes it has followed proper procedure. There has been an
application received, a public hearing scheduled and then there is a recommendation by the
Planning Commission and a presentation to City Council for adoption of an ordinance which
requires a four-fifths vote.

Mr. Wissler indicated that the City keeps putting everything off because of what happened -
because a resident attorney showed the City laws that were broken.

Charles Lund, K.C. Land Company, indicated that K.C. Land Company responded to an ad in the
Minneapolis Tribune that Ramsey had land to sell. K.C. was one of five or six bidders and K.C.
was determined to be the high bid and all they have been trying to do is a nice development and
intend to follow through with that.

Mr. Wissler inquired of Mr. Lund as to what Real Estate Company he has working for him.

Chairperson Bawden indicated that he (Bawden) is employed by Prudential Realty and he has no
idea if his company will be involved in the marketing of Alpine Estates.

Commissioner Deemer noted that Mr. Wissler is making an inference.

Planning Commission/Public Hearing/K.C.
