City Engineer Jankowski explained that staff interpreted the building to be a commercial structure <br />which would require 50 percent of the exterior to be something other than metal. If Commission <br />considers the building to be agricultural, compliance is not necessary. <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Terry to approve findings of fact <br />1 through 19. <br /> <br />Motion carded. Voting Yes: Acting Chairperson Deemer, Commissioners Holland, Terry, Jensen, <br />and LaDue. Voting No: None. Absent: Chairperson Bawden and Commissioner Thorud. <br /> <br />Chairperson Deemer noted that the seedlings m the right-of-way that currently provide screening will <br />be bulldozed^when the 155th is reconstructed. <br /> <br />Mr. Hansen stated that they were notified by the traffic engineer that the road work on 155th would <br />take approximately 100 to 200 feet, and the area of the building would not be affected. Trees will <br />surround pole barn, and that is the reason it was set back 100 feet from the setback line. <br /> <br />Commissioner Jensen stated that she would like to see more trees, 33 percent exterior other than <br />metal and the entire plan work together. <br /> <br />Acting Chairperson Deemer stated that the top six feet of the pole barn will be seen by passing traffic <br />on the road. <br /> <br />Commissioner LaDue suggested discussing the exterior when a site plan is submitted. <br /> <br />City Engineer Jankowski stated that as a commercial building, a site plan would be required. <br /> <br />It was the consensus of the Commission to require a site plan as part of the conditional use permit <br />process. <br /> <br />Motion by Acting Chairperson Deemer and seconded by Commissioner Jensen to add condition No. <br />9 to state that no other retail activity will be allowed in the pole barn except as it relates to the <br />growing and selling of trees on the property and tree accessories between November 1 and January <br />1 of each year. <br /> <br />Discussion: <br /> <br />Acting Chairperson Deemer explained that this condition would protect the City from other retail <br />uses, if the property were sold with the conditional use permit in effect for retail activity. A tree can <br />be sold from the property at any time, but the sale of accessories would be limited. <br /> <br />Commissioner Holland expressed concem that the proposed condition No. 9 would limit the Hansen's <br />business opportunity. <br /> <br />Planning Commission/May 6, 1997 <br /> Page 4 of 11 <br /> <br /> <br />
