Case #4A: <br /> <br />Review Proposed Chapter 9 Amendments - Page 10 of City Council Minutes <br />Dated October 14, 1997 <br /> <br />Commissioner Deemer indicated language under section 9.12.13 (page 350) regarding non- <br />conforming signs, which the City Attorney referred to, is the most restrictive application which <br />applies. He indicated page 298 puts a new meaning to the language in 9.12.13 Subdivision 1, <br />pertaining to the market value. He indicated it takes the right to establish the market value away from <br />the sign company, and gives the ability to the City Assessor. Therefore, he stated, people should not <br />be allowed to reconstruct their billboard or off-site advertising signs. He stated ifa sign costs more <br />than 50-percent to reconstruct, it needs to be removed. He indicated his intent for bringing this up <br />was to enlighten the City Attorney on the way the code is written. <br /> <br />Motion by Commissioner Holland, seconded by Commissioner Jensen, that the City Attorney be <br />directed to item 4A for his review. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Jensen, Deemer, <br />LaDue, Terry, and Thorud. Voting No: None. Absent: None. <br /> <br />Case #4: Review Proposed Chapter 9 Amendments <br /> <br />Commissioner Jensen indicated she had not been able to thoroughly review the Chapter 9 <br />Amendments. <br /> <br />Motion by Commissioner Jensen, seconded by Commissioner Holland, that the review of the <br />proposed Chapter 9 Amendments, be tabled. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Jensen, Holland, Deemer, <br />LaDue, Terry, and Thorud. Voting No: None. Absent: None. <br /> <br />Case #5: Monthly Status Report <br /> <br />Commissioner Jensen questioned if Council is allowing the Burger King facility to have metal siding <br />as opposed to natural or prefabricated brick or stone, which was originally approved on September <br />9, 1996. <br /> <br />Commissioner Deemer indicated a sample of the metal was presented to the Council for their <br />approval. <br /> <br />Commissioner Jensen asked ifRamsey was lowering their standards. Chairperson Bawden stated that <br />over time, things change and the ordinance should be flexible enough to allow change. <br /> <br />Commissioner Jensen requested that going forward, samples be provided to the Planning Commission <br />for review.
