CSAH 5 from Sunwood Drive to 150`h Lane and also requested the City put fencing in along the <br />path. Mr. Whaley has reported that school children are cutting through his yard to access the <br />path. Mr. Whaley has suggested that the City fence the portion of the trail behind his house and <br />he would fence in the side yard area. Staff reported that in researching pricing for fencing, it <br />would .cost approximately $25 per lineal foot and would be about $3,200. If the City chose to do <br />this, it would have a substantial impact on how much of the trail system the City can construct. <br />Staff. recommends that the City reaffirm the current policy that fencing along trails is at the <br />discretion and cost of the property owner, <br />Motion to recommend that the City Council reaffirm the current policy of requiring fencing to be <br />placed along trails at the discretion and expense of the property owner, and also direct staff to <br />research what kinds of hedges or green privacy barriers would be appropriate along trails and <br />work on setting up a program so the City can provide those to property owners at cost. <br />Action: <br />Ratify the recommendation of the Public Works Committee. <br />Case #3 Update on Highlands at River Park Pond <br />Background: <br />Staff has been working with residents surrounding. the lined pond located between Xkimo Street <br />and Yakima Court and Yakima Street in Highlands River Park. Dye testing was done in August <br />and also in early October to try to determine if and where the leak is occurring. After the most <br />recent dye testing, it appears that the breach or one of the breaches may be located near the <br />border of lots 13 and 14. <br />Motion to direct staff to acquire the dye powder and specific instructions on its use and have the <br />City Attorney review whether the Letters of Credit can be used if the City finds out the breach <br />was caused by negligence or improper installation. <br />Action: <br />Ratify the recommendation of the Public Works Committee. <br />Case #4: Consider Request from Oakwood Land Development Inc. Regarding <br />Brookfield Trail Reimbursement <br />Background: <br />The City received a letter from John Peterson of Oakwood Land Development requesting <br />additional reimbursement for trail construction. In the development agreement a dollar amount <br />of $14.09 per foot was specified but when the trail was constructed, there was a significant <br />amount of trees that needed to be removed. Oakwood Development is requesting an additional <br />$80,615.45, which is a 92% increase in the anticipated. payment. Mr. John Peterson signed the <br />development .agreement and the trail has been completed. Staff suggested that in the future, <br />-128- <br />
