Case #5: Request for Conditional Use Permit to Grade and Export Soils; Case <br /> of Good Value Homes, Inc. <br /> <br />Zoning Administrator Frolik reported that the grading plan submitted for approval with the <br />Pondview preliminary plat will require exporting approximately 120,000 yards of material from the <br />site. City Code requires a special permit for grading operations associated with an approved plat <br />when exporting soils from the site. There are three haul road access points proposed, two on C.R. <br />#116 and one on 149th Avenue, and City Staff suggests restricting these only to C.R. #116 and <br />not using 149th. <br /> <br />Derrick Passe, Passe Engineering, stated that 149th Avenue is on Good Value Homes' property as <br />constructed. <br /> <br />The Planning Commission proceeded to review the Findings of Fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to accept #1 through <br />#11 as presented. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Jensen, <br />LaDue, Terry, and Thorud. Voting No: None. <br /> <br />With reference to #7, Mr. Passe stated the top soil will have to be replaced and he would have to <br />import 10-20,000 yards of material. <br /> <br />Commissioner Deemer commented that top soil is not fill. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Holland to amend #7 to read <br />"That no fill materials except top soil and restoration are proposed to be imported to the site." <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners LaDue, Holland, Deemer, <br />Jensen, Terry, and Thom& Voting No: None. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to amend #12 through <br />#18 in the affirrnative. <br /> <br />Further Discussion: Commissioner Deemer inquired about holding down dust in the dry season, <br />and Chairperson Bawden replied that should be in the permit. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Jensen, <br />LaDue, Terry, and Thomd. Voting No: None. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Deemer to recommend that City <br />Council adopt the amended Findings of Fact relating to Good Value Homes' request for a <br />conditional use permit to grade and export soils. <br /> <br />Amendment by Commissioner Deemer and seconded by Commissioner Thorud to add a finding to <br />read "There were no objections stated at the public hearing of this matter." <br /> <br />Amendment carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Thorud, <br />Holland, Jensen, LaDue, and Terry. Voting No: None. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners LaDue, Deemer, Holland, <br />Jensen, Terry, and Thorud.
