Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Deemer, Jensen, <br />LaDue, Terry, and Thorud. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend Council <br />approval of the amended Findings of Fact. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Jensen, <br />LaDue, Terry, and Thorud. Voting No: None. Absent: None. <br /> <br />The Commission proceeded to review the proposed conditional use permit. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to amend #1 to <br />indicate that no additional fill beyond topsoils shall be allowed to be imported and to recommend <br />Council approval of the permit. <br /> <br />Motion Carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Jensen, <br />LaDue, Terry, and Thorud. Voting No: None. Absent: None. <br /> <br />Case #4: <br /> <br />Request for Conditional Use Permit for Grading and Filling; case of John <br />Peterson <br /> <br />Commissioner Holland inquired status of the DNR's involvement in the case at hand. Mr. <br />Jankowski responded the DNR has issued a cease and desist order while determination of <br />violation is being considered. <br /> <br />In response to Chairperson Bawden, Mr. Jankowski indicated the easement's width is 66 feet. <br /> <br />Commissioner Deemer and Mr. Jankowski agreed drainage is an issue which needs to be <br />addressed in the very near future; prior to Spring melt precipitation being an issue. It is believed <br />input from residents residing on the property would help in determining effective culvert <br />placement. <br /> <br />The Commission proceeded to review the Findings of Fact relating to a request from John <br />Peterson for a conditional use permit for grading and filling. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to amend #6 to <br />indicate that the Applicant has imported an undetermined volume of earth material onto the <br />subject Property for the purpose of improving an access; eliminating the word "drive." <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Jensen, <br />LaDue, Terry, and Thorud. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Thorud to amend #10 to <br />indicate that the filling that occurred is not a substantial improvement to property. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Thorud, Holland, <br />Jensen, LaDue, and Terry. Voting No: None.
