Motion by Commissioner Holland and seconded by Commissioner ~Iensen to amend #11 to indicate that the filling will not create excessive additional requirements at public cost for public facilities and services, and will not be detrimental to the economic welfare of the community. Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Jensen, Deemer, LaDue, Terry, and Thorud. Voting No: None. Absent: None. Motion by Commissioner Holland and seconded by Commissioner Deemer to recommend Council approval of the amended Findings of Fact. Motion Carried. The Commission proceeded to review the proposed terms of permit for grading and filling. Motion by Commissioner Holland and seconded by Commissioner Jensen to amend #5 to indicate in the event any of the Permit conditions are not met within the specified time frame, the City shall cause the necessary work to be performed and shall bill the Permittee for the cost of the work plus a ten percent (10%) administrative charge. If not paid, the Permittee agrees to have this charge certified as a special assessment to the property, known as the Northeast Quarter of the Northeast Quarter of Section 9, Township 32, Range 25, Anoka County, Minnesota. Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Holland, Jensen, Deemer, LaDue, Terry, and Thorud. Voting No: None. Absent: None. Motion by Commissioner Terry and seconded by Commissioner Deemer to add #6 indicating that no additional fill materials, excluding top soil, are to be imported on the Subject Property. Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Terry, Deemer, Holland, Jensen, LaDue, and Thorud. Voting No: None. Absent: None. Motion by Commissioner Holland and seconded by Commissioner Jensen to amend #1 to indicate that the Permittee shall re-establish natural drainage by replacing the existing 12-inch culvert, with a 15-inch smooth interior culvert. The culvert shall include a flared end section on the upstream side to enhance flow characteristics. The culvert shall be set no greater than 0.1 feet higher than the invert of the downstream corrugated metal pipe culvert. The culvert material may be polyethylene, but it shall conform to class I reinforced concrete pipe strength specification. The culvert shall be installed within 45 days of approval of the permit by City Council so that it will be functional to handle precipitation/melt events which occur in the Spring of 1997.
