as described above cannot be acquired by direct negotiation on or before February 15, 1996, they <br />shall be acquired by eminent domain. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to adopt <br />Resolution g96-01-030, as amended, authorizing an eminent domain action with regard to certain <br />of the easement parcels necessary for Improvement Project g95-12. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beahen, Beyer and <br />Peterson. Voting No: None. <br /> <br />Case #8: Anoka Municipal Electric Transmission Line <br /> <br />City Administrator Schroeder stated that the City of Anoka utility company is proposing to <br />construct a 69KV electric transmission line. They have been proposing to construct the line on a <br />straight north/south direction which runs by the western property line of the property we just <br />acquired from Altron for Sunwood Drive. That land is about 2.5 acres. The concern of City staff <br />is that Anoka Municipal Utility route their transmission line in such a way as to not negatively <br />impact the marketability of this parcel. Anoka Electric Cooperative, the adjacent property owner, <br />had the same concern regarding their property. AMU's position is that they do not believe that this <br />transmission line alignment has a negative impact. He noted the board presentation that the AEC <br />staff prepared regarding the alignment. The proposal is that we allow AMU to construct their <br />transmission line as they originally proposed, however, if a future user on our property or the AEC <br />property needed to have the line moved in the future to facilitate development, AMU would cause <br />that to happen at their expense. <br /> <br />Mayor Hardin questioned how "anxious" they would be to move that line. <br /> <br />Mr. Schroeder replied that the letters were have from them commit them to move the line at the <br />City's request. <br /> <br />Councilmember Peterson commented that he would feel better if a formal agreement to that affect <br />were drafted. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beahen to direct staff and <br />the City Attorney to proceed - come up with a formal agreement and what our City Attorney feels <br />would benefit and protect our rights. Present this agreement back to the City Council for approval. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beahen, Beyer and <br />Zimmerman. Voting No. None. <br /> <br />Case <br /> <br />Review Proposed Ordinance to Amend Chapters 5 and 9 of Ramsey <br />City Code Regarding Parking and Storing Vehicles and Equipment in <br />Residential Districts <br /> <br />Zoning Administrator Frolik stated that, as per Council's direction, the Planning Commission has <br />been working for several months to draft an ordinance to amend the City Code to make allowances <br />for parking and storing commercial vehicles in residential districts. She recited the following <br />amendments: a) Any number of licensed, operable, private use motor vehicles and one <br />unlicensed, operable, private use motor vehicle may be stored outside on a paved or gravel surface; <br />b) any number of private use equipment used for private purposes may be stored outside; c) any <br />number of commercial vehicles and equipment may be stored indoors; d) any number of <br />commercial vehicles and equipment may be stored outdoors if they are stored on a paved or gravel <br />surface and are 75% screened from the public road or adjacent; neighbors; and e) no junk <br /> <br />City Council/January 23, 1996 <br /> Page 8 of 15 <br /> <br /> <br />
