Mayor Hardin noted that the other candidates were interviewed in private. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Zimmerman to recess the <br />regular meeting of the City Council at 8:29 p.m. in order for Councilmember Beahen to 'conduct an <br />interview of Mr. Hendriksen. <br /> <br />Mayor Hardin called the regular portion of the City Council meeting back to order at 8:37 p.m. <br /> <br />Mr. Hendriksen stated that the people here know there's nothing wrong with him as a Planning <br />Commissioner. It was a unanimous recommendation by the Planning Commission to reappoint <br />him. He felt that this is a retaliation for exposing Mayor Hardin's tax records and questioning the <br />open meeting law with regard to Councilmembers Beahen, Peterson and Hardin. He noted that <br />employer retaliation is prohibited by law and that the City of Princeton lost a similar case after <br />spending hundreds of thousands of dollars. Mr. Hendriksen asked that his lawsuit against the City <br />of Ramsey be submitted to binding arbitration. He expressed concern about these three members <br />of the Council being willing to spend the taxpayers money when it is not necessary. He asked that <br />Mayor Hardin and Councilmembers Beahen and Peterson abstain from voting. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beahen to appoint Ms. <br />Sharon Jensen to the Planning Commission for a term to expire on December 31, 1997. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson and Beahen. Voting No: <br />Councilmembers Beyer and Zimmerman. <br /> <br />Councilmember Zimmerman commented that this action cost the taxpayers an unnecessary amount <br />of money - there is another solution to this. <br /> <br />Case #12: <br /> <br />Adopt Ordinance to Amend Chapter 9 (Zoning and Subdivision of <br />Land) of the Ramsey City Code Regarding Structure Setbacks from <br />Thoroughfares <br /> <br />Zoning Administrator Frolik stated that this is the second reading of the ordinance amending <br />Chapter 9 of the City Code. This ordinance would establish a structure setback of 60 feet from <br />right-of-way centerline plus the local applicable setback. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Peterson to adopt Ordinance <br />g96-05 to amend the structure setback from thoroughfares to 60 feet from centerline plus the local <br />applicable setback. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen, Peterson, Beyer and <br />Zimmerman. Voting No: None. <br /> <br />Councilmember Beyer recollected that the City Charter calls for a roll call vote on ordinances. <br /> <br />City Attorney Goodrich stated that the Charter does not call for a roll call vote but that Council may <br />have a roll call vote if they desire. <br /> <br />Case #13: Schedule Neighborhood Meeting Relating to Game Fair 1996 <br /> <br />City Administrator Schroeder reported that Council appointed him to a task force along with Mayor <br />Hardin to talk to Game Fair operators. It was suggested that a neighborhood meeting should be <br />conducted in addition to that. The meeting is scheduled for 7:00 p.m., on Thursday, March 28, <br />1996.
