Voting No: None. <br /> <br />Case ~/: <br /> <br />Request for Site Plan Approval of Bank Facility; Case of Riverside <br />Development <br /> <br />Zoning Administrator Frolik reported that Riverside Development has applied for site plan approval <br />of a bank facility to be consumcted on Lots 3 and 4, Block 1, River's Bend Plaza 3rd Addition. <br />The proposed project meets City Code requirements for zoning, lot coverage, setbacks, <br />architectural standards, waste storage and design, and number of off-street parking spaces. A <br />right-in access only is proposed to the site from T.H. #47. This access point is inconsistent with <br />the recommendations of the draft T.H. #47 Corridor Study which seeks a long term reduction of <br />the number of access points along the highway to preserve its mobility function. Existing access <br />points are available 320 feet north and 200 feet south of the proposed access. The plan has been <br />forwarded to MnDOT for review and comment; however, no comment has yet been received. Ms. <br />Frolik suggested that in the event some type of residential use is developed on the east side of <br />Xkimo Street in the future, screening be established at this time along Xkimo Street. The Planning <br />Commission reviewed the plan and recommended approval contingent upon MnDOT's approval of <br />the right-in only from T.H. #47, resolving the depth of the landscape area adjacent to Xkimo at the <br />time a facility expansion is applied for, and not requiring the installation of screening along the east <br />property line. <br /> <br />Rick Foster, Developer, stated that this land has a lot of history. In 1979, he donated River's <br />Bend Park, the #116 Corridor and 75 additional feet on the highway - 130 feet on the east side. <br />For this he received consideration that his park dedication fees for all projects in River's Bend were <br />paid and a 15 to 20% variance in lot sizes and setbacks. In 1984, he built River's Bend 2nd <br />apartments. There were numerous meetings with City staff, etc. Discussed was access from <br />Highway #47 to his property. The right of access was mentioned several times and MnDOT did <br />not see a problem with it. Two years ago, he said he ran into Bill Warden of MnDOT and he <br />(Warden) did not see a problem with that. Mr, Foster explained that he is looking for a nice place <br />to put a nice building and that's Ramsey. He feels he owes that to Ramsey as this is where he got <br />his start. He reported that he contacted Mr. Warden at 9:00 this morning - faxing him a copy of his <br />plan. At 1:15 p.m., Mr. Warden called and said he "walked it around" and no one has a problem <br />with it. He suggested moving the access off 142nd, east, about 150 feet. Mr. Foster stated that <br />he has submitted the site plan to the state but has not yet received a review letter. This has been <br />discussed at length with MnDOT with no written results yet. He asked that if it comes back <br />negative, that he be allowed to talk with MnDOT. He then commented on the escrow amount of <br />$50,000. He stated he would like to demonstrate this to staff that it may be excessive. If he can <br />prove it's excessive, he inquired if he could then escrow less. <br /> <br />City Administrator Schroeder responded that on things like escrow, always if you have supporting <br />evidence that the numbers should be less, it happens. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to approve <br />Riverside Development's proposed site plan for a bank facility in accordance with the <br />recommendations of MnDOT on the turn lanes and that the developer discuss with staff the <br />reduction in escrow, that Xkimo does not have to be screened, and if the letter comes back from <br />MnDOT to the negative, that Mr. Foster has the opportunity to go back and re-negotiate. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Zimmerman, Beahen and <br />Beyer.
