Motion by Councilmember Beyer and seconded by Councilmember Beahen to direct Staff to place <br />an ad for this property requesting sealed bids to have them back by May 14, 1996, for City <br />Council consideration. <br /> <br />Further discussion: Councilmember Peterson inquired what if someone submits a bid that they <br />cannot hope to meet. He felt it would be a waste of time. Councilmember Beyer suggested only <br />serious bids would be given. Mr. Goodrich pointed out that the City could ask for a 5% bid bond <br />or cash. <br /> <br />Amendment by Councilmember Beyer and seconded by Councilmember Beahen that the bidder <br />provide the City with a 5% down payment at the time of the bid. <br /> <br />Amendment carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Beahen, Peterson and <br />Zimmerman.. Voting No: None. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #8: Ordinance to Sell Lot 9, Block 5, Chestnut Ridge 2nd Addition; <br /> D.A.R.E. Project <br /> <br />City Administrator Schroeder reminded Council that the City initiated a housing construction <br />project within the Chestnut Ridge Subdivision, the proceeds from which will be dedicated toward <br />the D.A.R.E. Program. While the actual construction of this home has not yet begun, staff is <br />asking for Council initiation of the property sale process by introducing the required ordinance <br />authorizing disposal of the property. <br /> <br />Councilmember Peterson inquired how it is good to follow one procedure for one case but not for <br />another. To Councilmember Beyer he exclaimed that you cannot have it both ways, you cannot <br />pick and choose who you wish to give the breaks to. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beahen to introduce the <br />ordinance authorizing the sale of Lot 9, Block 5, Chestnut Ridge 2nd Addition. <br /> <br />Further discussion: Councilmember Peterson inquired of the City Attorney if it can be done both <br />ways. Attomey Goodrich replied that you do not need a bid process but you have established a <br />procedure. To do it this way is not illegal. Councilmember Beyer stated that we have time on this. <br />We will have a home built on this. Councilmember Peterson inquired how that is different. <br />Councilmember Beyer stated it's not different but we have time. The other one has a subdivision <br />depending on it and we have time to hash this over. Councilmember Peterson stated he did not <br />believe Councilmember Beyer had any intent to go back and hash it out. He felt that she singled <br />out Case #7 and that this should be treated the same. He inquired why Council is acting on this ff <br />we are not intending to sell this. Mr. Schroeder stated that the City will be the title holder, the City <br />has to see to it the house is constructed and then the property/house is sold. Councilmember Beyer <br />stated that when we sell this we should have an appraised value and we can ask that price for it. <br />Councilmember Peterson argued that Councilmember Beyer would not accept that for Case #7. <br />Councilmember Zimmerman felt that this is two different issues. Councilmember Peterson felt it <br />was the same. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beahen, Beyer and <br />Zimmerman.
