Councilmember Beyer expressed concerns about exporting soils on City streets and County roads. <br />They have been a mess - they are destroying part of the roadway. How will we get it cleaned up. <br /> <br />Ms. Frolik replied there are conditions in the agreement. <br /> <br />Councihnember Beyer asked about extra police because of anxious drivers pulling out of the area. <br /> <br />Ms. Frolik responded that there have been no complaints. <br /> <br />Motion by Councihnember Peterson and seconded by Councilmember Beahen to adopt Resolution <br />#964)6-146 adopting Findings of Fact #0403 relating to a request from Edson Investment Limited <br />Partnership for a conditional use permit to grade and export soils. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beahen and Beyer. <br />Voting No: None. Absent: Councih-nemberZimmem-~an. <br /> <br />Motion by Councihnember Peterson and seconded by Councilmember Beahen to adopt Resolution <br />#96-06-147 approviug the issuance of a conditional use permit based on Findings of Fact #0403 <br />and declaring terms of permit to grade and export soils. <br /> <br />Motion carried. Absent: CouncihnemberZimmerman. <br /> <br />Case #8: Acquisition of Drainage and Utility Easements <br /> <br />City Engineer Jankowski stated that sewer and watemmins will need to be extended to service both <br />the Brandseth subdivision and the City Hall complex which includes the new police building. <br />Initially it was proposed that the utilities be extended northward along the west frontage road along <br />T.H. #47 to the southeast corner of tile Brandseth subdivision. This extension would have <br />required the acquisition of an easement fi'om the Kempf property. The Kempfs, however, <br />expressed concern over this route its it would require significant construction impacts to the front <br />of their property including the loss of mature trees which buffer their residence from T.H. #47. <br />Therefore, we have negotiated an alternative route with the three property owners immediately west <br />of the service road. It wits agreed that a utility corridor running through the rear and side yard <br />would be a superior route for the following reasons: there are few impacts to mature trees or other <br />significant landscaping features, restoration costs would be significantly lower as only tuff <br />restoration would be required, the cost of utility installation would be lower as there would be <br />shallower trench cuts and fewer existing utilities to contend with, the alternate route would provide <br />service to two or three additional properties itt virtually no extra cost compared to the original route, <br />the neighbors am supportive of this route. The chosen corridor will accommodate sanitary sewer, <br />watermain and stom~ sewer within a 40 foot pem~anent easement. A 10-foot existing easement <br />along the west boundary of Block 1, Gorham's Addition, will provide a portion of the required <br />corridor. This leaves the acquisition of easement from two property owners, (1) a 7,640 square <br />foot easement fi'om Al and Kathy Kempf; and (2) a 4,885 square foot easement from Lawrence <br />Ducommun. Both property owners have had an appraisal prepared for their respective properties <br />which value the easement at $1.26 per square foot. This unit price is higher than the City has <br />experienced on previous right-of-way easement acquisitions. In reviewing 14 appraisals the City <br />has commissioned over the last five years, the unit price of land ranging from as little as $0.06 per <br />square foot to as much as $0.47 per square foot. However, in checking with Anoka County, an <br />appraisal for land acquired for tile Round Lake Boulevard expansion was $1.00 per square foot. <br />Both property owners have verbally agreed to grant the easement for $1.00 per square foot plus the <br />cost of two appraisals totaling $790. This would make the total cost $13,315. Funding would be <br />obtained from the City's Sewer and Water Trunk Fund. <br /> <br />City Council/June 11, 1996 <br /> Page 10 of 13 <br /> <br /> <br />
