Motion carded. Voting Yes: Chairperson Deemer, Board Members Bawden, Terry, Holland, Jensen, <br />LaDue, and Thorud. Voting No: None. Absent: None. <br /> <br />The Board of Adjustment proceeded to review the terms of the variance. <br /> <br />Board Member Bawden pointed out the problem with the legal description. Chairperson Bawden <br />asked if there were any concerns other than with the legal description. <br /> <br />Board Member Thorud asked if the applicant may need more than 458 feet, and asked if450 feet <br />would be better. Mr. Clampitt stated that his measurements were not exact, and an additional eight <br />feet would be helpful. <br /> <br />Motion by Board Member Thorud and seconded by Board Member Terry to amend #2 to read four <br />hundred fit~y (450) feet from the front property line. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Thorud, Terry, Bawden, <br />Holland, Jensen, and LaDue. Voting No: None. Absent: None. <br /> <br />Motion by Board Member Thorud and seconded by Board Member Holland to approve the issuance <br />ora variance for David Clampitt, based on Findings of Fact #0409, and adopt Resolution #96-09-213 <br />declaring terms of the variance as presented. <br /> <br />Further Discussion: Board Member Bawden stated that the legal description should describe what <br />has been submitted in the drawing. <br /> <br />Amendment by Board Member Thorud and seconded by Board Member Jensen to amend the <br />previous motion to include a correct legal description. <br /> <br />Amendment carried. Voting Yes: Chairperson Deemer, Board Members Thorud, Jensen, Bawden, <br />Holland, LaDue, and Terry. Voting No: None. Absent: None. <br /> <br />Motion carried. Absent: None. <br /> <br />Case #2: <br /> <br />Request for a Variance to Construct an Accessory Structure Nearer the Front <br />Property Line than the Principal Structure; Case of Stephen Schmidt <br /> <br />Zoning Administrator Sylvia Frolik explained that City Staffhas visited this site and verified that a <br />great deal of the applicant's backyard is concealed by mature trees, declining topography and <br />wetlands.
